2017 :
In 2017 NLF won three Workers' Compensation Formal Hearings, including one "Osterlund" permanent total claim and won three Federal District Court appeals, in addition to numerous Social Security claims. The Firm additionally prevailed at the Workers' Compensation Commission Review Board.
On October 24, 2017 NLF prevailed at the 2nd Circuit Court of Appeals in New York City, where a win at the Federal District Court was affirmed.
$222,500.00 Workers' Compensation Settlement: Client suffered post concussive syndrome after a fall at work. Injury required therapies and treatment to address vestibular issues. Resolution of the claim was after successful Social Security Disability claim and language to avoid offset of benefits and MSA.
$150,000.00 Workers Compensation Settlement: The Claimant suffered a knee injury at work superimposed upon a pre existing degenerative arthritic condition. After a total knee arthroplasty the claimant returned to full time work at a different employer making similar wages.
$140,000.00 Workers' Compensation Settlement: The client suffered an injury to his knee at work. After a total knee replacement he was released to full duty work with regard to his knee condition. He has another workers compensation claim that is disabling that is still pending which necessitated our bringing a successful Social Security Disability claim. Offset language and MSA were utilized to maximize his recovery.
$184,000.00 Workers' Compensation Settlement: The Claimant injured his back, knee and shoulder at work in is self employed profession. He was required to hire help to assist him continue his business. After arthroscopic surgery to his knee and treatment to his back and shoulder the claim settled. We brought a successful Social Security Disability claim on his behalf as well and maximized his recovery utilizing a MSA and allocation language in his stipulation.
$102,500.00 Workers' Compensation Settlement: The client suffered a shoulder injury at work necessitation surgical repair. The outcome was good and the client returned to work with a different company out of State.
$125,000.00 Workers' Compensation Settlement: The Claimant sustained a work related back injury that resulted in substantial missed time. The Claimant was paid for all of temporary total benefits for time out of work and mileage and medical expenses. There was a recommendation for surgery but the Claimant opted for non surgical treatment. After a period of recovery the Claimant returned to work elsewhere.
$115,000.00 Workers' Compensation Settlement: The Claimant injured her low back at work. She continued working in pain but ultimately elected to move out of state and take other employment. The Settlement encompassed the future risk for the permanent partial disability benefits, future total disability and partial disability and medical exposure.
2016 :
$350,000.00 Workers' Compensation Settlement: In a case that evolved over a 23 year period an involved several successful Formal Hearings and two different dates of injuries and two Insurance carriers sharing the risk, the Claimant finally settled the claim after we successful filed an application for Social Security Disability. The claim was complicated by a non work related neck injury that a was also disabling in addition to the work related low back injury which was disabling as well. The client had surgery to the low back.
$120,00.00 Personal injury Settlement: The client suffered an injured knee which required arthroscopic surgery after he fell on a set of stairs that was defective. The clam settled on the eve of trial.
$102,000.00 Workers' Compensation Settlement: Claimant suffered a low back injury at work. Lumbar surgery was suggested by two of three doctors but was complicated by the claimant's co-morbidities. The claim settled after the client opted not to undergo surgery and was rated for a 10%. Claimant availed himself of Vocational Rehabilitative retraining.
$196,000.00. Workers' Compensation Settlement. The client sustained a right master arm surgery that necessitated two shoulder surgeries. The claimant was rated for disability and relocated to a new employer making similar earnings in a lighter duty capacity. Claimant was in management.
$125,000.00 Workers' Compensation Settlement. The client sustained a low back injury and had a lumbar fusion with good results. After the claimant exhausted all benefits due and transferred to a new employer the case settled for $125,000.00 new money.
$100,000.00 Personal Injury/Motor Vehicle Accident passenger Settlement: Child seat belted in car seat sustained a facial scar while a rear seat passenger in a motor vehicle head on collision. The $100,000.00 was all the insurance available and involved exhausting the first $20,000.00 policy for the asset free/judgment proof at fault driver and then the remaining $80,000.00 on the Underinsured motorist policy of the family/Household policy.
2015 :
$535,000.00 Workers' Compensation Settlement: Client injured cervical spine in the course of employment, ultimately undergoing two fusion surgeries.
$480,000.00 Workers' Compensation Settlement: Client suffered head trauma that caused permanent damage and impacted all facets of daily life.
$119,000.00 Workers' Compensation Settlement: Client suffered a herniated disc while lifting at work. The injury did not require surgery.
$132,500.00 Workers' Compensation Settlement: Client suffered a lower back injury that required surgery and that was superimposed on a prior low back injury. Another surgery was required to repair the damage to his low back. Client made a good recovery and moved on to work at another employer.
$150,000.00 Personal Injury; Cyclist hit by motor vehicle Settlement: Client was a nineteen-year-old returning home from work while on his bicycle at night in the rain. Defendant struck him and he suffered a broken tibia which required an open reduction surgery to repair. Client made a full recovery. Client was ticketed for no reflectors and Defendant was ticketed for failure to grant right of way. Case settled at mediation.
$688,000.00 Personal Injury Motor Vehicle Accident/Workers' Compensation combined Settlement: Client was hit from behind in work truck while performing work duties. He suffered lower back and neck injuries. He required a lumbar fusion to repair his low back. The policy limits for the tortfeasor who hit him from behind were exhausted. A claim was made against the employer’s Underinsured Motorist policy and workers' compensation policy. The claim settled at mediation with the workers' compensation carrier contributing a substantial amount and waiving the moratorium with the underinsured carrier making a substantial contribution as well.
$125,000.00 Workers' Compensation Settlement: Client, employed by a big box retail store with a low compensation rate, closed out his claims for his soft tissue ankle and cervical spine injuries.
$120,000.00 Motor Vehicle Accident Settlement: Client was struck from behind and suffered a lower back injury requiring a diskectomy at one level. Plaintiff made a recovery and returned to full duty work.
$345,000.00 Motor Vehicle Accident Settlement: Client was hit directly on the driver’s side door by Defendant and suffered post concussive syndrome and a cervical spine injury. Client recovered but required epidural and facet injections and returned to work full time.
$100,000.00 Workers' Compensation Settlement: Client had a preexisting lower back condition for which surgery was contemplated and recommended. While continuing to treat, the claimant fell at work and this accelerated the need for surgery. Respondents contested the causal connection.
2014:
$115,000.00 Workers' Compensation Settlement: Client injured low back in disputed lifting incident. Injury was non-surgical. Client returned to work at different employer.

$130,000.00 Workers' Compensation Settlement: Client suffered low back injuries requiring a discektomy surgery. Client returned to work at a different employer.
$569,000.00 Workers' Compensation Settlement: Client underwent two fusion surgeries to the lumbar spine and had a pain stimulator installed in her lower back.

2011:
$850,000.00 Motor Vehicle Settlement: Decedent was passenger in motor vehicle that was struck by hit and run Defendant driver who fled the scene.
$125,000.00 Motorcycle Accident: Mediation Uninsured Motorist Settlement: Client motorcyclist was hit from behind while stopped. Client suffered subdural brain bleed and was left with diminished taste and smell. Attorney Nicholas later testified at trial in the insurance carrier’s subrogation claim against the uninsured operator when they defended the suit by claiming the Uninsured Motorist carrier paid the Nicholas Law Firm too much in compensation for the injuries and damages sustained by the client.
$145,000.00 Motor Vehicle Accident Settlement: Client injured in motor vehicle collision had treating physician’s opinion that future low back surgery remained a significant possibility.
2010:
$500,000.00 Workers' Compensation Settlement: Client injured low back and knee and required multiple surgeries. The client ultimately returned to work after several years.
$130,000.00 Workers' Compensation Settlement: Client injured low back and faced potential future low back surgery.
$154,773.00 Motor Vehicle Accident Arbitration Award: Client suffered injuries to pre-existing conditions in his low back in a motor vehicle accident. Insurance company's doctor opined accident was not a factor in his symptoms and need for surgery. Plaintiff’s treating physician found surgery and treatment was necessitated by trauma suffered in accident. Insurance company made no offer to settle the claim before Arbitration
2009:
$145,000.00 Defective premises Settlement: Client fell in tub at day spa and suffered post-concussive syndrome with scarring from lacerations suffered in the fall.
$175,000.00 Workers' Compensation Settlement, Indemnity only: Client suffered neck and arm injuries and required fusion surgery to the cervical spine. Medical treatment left open.
2008:
$900,000.00 Motor Vehicle Accident Settlement: Client was in his vehicle when at-fault motor vehicle crossed road and struck him head on. Plaintiff required multiple surgeries to neck, knee, shoulder and wrist.
$305,000.00 Workers' Compensation Settlement: Client developed occupational asthma over the period of his employment.
$197,844.00 Workers' Compensation Settlement: Client suffered low back injury and required two surgeries to low back to repair damage sustained in work injury.
$130,000.00 Workers' Compensation settlement: Client suffered low back injury and required disckectomy surgery on lumbar spine and returned to work full-duty at a different employer.
2007:
$100,000.00 Motor Vehicle Settlement: Client hit head on suffered multiple systems trauma. Policy limits of the defendant was exhausted.
$593,000.00 Workers' Compensation Settlement: Client sustained work related injury to knee and required total knee arthroscopy that became infected and required multiple surgeries to repair.
$110,000.00 Workers' Compensation Settlement: Client sustained injury to knee and required several corrective surgeries.
2006:
$840,000.00 Motor Vehicle/Dram Settlement: Clients were passengers in a motor vehicle operated by a defendant who was found to be driving under the influence. The several bars where he was found to be drinking were put on notice. One passenger suffered a cervical injury that required a triple-level fusion. The other passenger had a scarring injury.
$413,822.35 Motor Vehicle Arbitration Award: Client was injured in a motor vehicle accident and required a lumbar fusion and had a long complicated recovery.
$285,000.00 Workers' Compensation Settlement: Client sought to reopen her long-archived workers' compensation claim after she moved to New Mexico. After a long, arduous process involving medical examinations in several states, this claim settled.
$165,000.00 Workers' Compensation Settlement: Client injured his big toe in the course of his employment. The injury was complicated by his diabetes. Respondent contested the extent of the injury. After a Formal hearing and arguments at the Compensation Review Board the claim settled.
$125,000.00 Workers' Compensation Settlement: Client injured his low back and was caused to miss substantial time from work. Client ultimately retired from the employer and made a recovery without surgery and commenced work for a different employer.
